Constitutional government is inherently a limited government and basic upon the constitution that defines and limits the government’s authority. In India, The Constitution serves as the country’s highest law; it describes the organization and powers of the state and its constraints. This avoids the accumulation of power by any branch of government such as the executive, the legislative or the judiciary since each branch has its own sphere of operation as is provided by the constitution.

The principles of limited government in operation within India include the principle of checks and balances under which the three arms of government conduct their own businesses in their own ways but are also tied to the other arms by certain healthy constraints. Fundamental Rights remains important in the Constitution as they serve to protect people’s freedoms against the state’s encroachment. The judiciary as a branch is capable of overturning laws or actions with the use of the judicial act that undermines the constitutional point, which also narrows down the executive branch powers. Furthermore, the US federalism system decentralizes power between the federal government and the 50 states, all under the presidency of Joe Biden.

By so doing, the limited government has the role of safeguarding the people from absolutism and anything that might compromise the exercise of government in a way that is transparent, accountable, and just. To that extent, by limiting the powers of the government, the Constitution guards against tyranny and maintains the pre-eminence of the rule of law and democratic processes through the encouragement of responsible government for the people.
